Requirements for Filing a Bankruptcy

 

In order to file a Bankruptcy, certain information must be provided to the court included in and in connection with your bankruptcy petition.  Please be advised that:

 

1.                  All information that you are required to provide with your petition and thereafter in connection with your case MUST be complete, accurate and truthful.

 

2.                  All assets and liabilities MUST be completely and accurately disclosed in the documents filed to commence your case.  The replacement value of each asset MUST be stated in those documents where requested.  A reasonable inquiry, by you, MUST be made to establish such value.

 

3.                  Your current monthly income and, for Chapter 13 cases only, your disposable income, MUST be stated accurately.  A reasonable inquiry, by you, MUST be made to establish such amounts.

 

4.                  Information that you provide during your case may be audited pursuant to BAPCPA 11 USC §527(a)(2)(D), and failure to provide any information may result in DISMISSAL of your case or other sanctions, including but not limited to, a criminal sanction.

 

This notice has been provided to you within three (3) business days of your meeting with our firm as required by BAPCPA, 11 USC §527(a)(2).
